I see nothing wrong with what was done. An order was given to disperse immediately and since they refused, it was necessary to arrest the violators, using the least amount of force necessary to effect this arrest. The 4th Amendment of the US Constitution states, "Only that amount of force that is reasonably necessary under the circumstances may be used to effect an arrest, prevent escape, or overcome resistance. (Headwaters Forest Defense v. County of Humboldt (9th Cir. 2002) 276 F.3rd 1125.)

"The Fourth Amendment prohibition against unreasonable seizures permits law enforcement officers to use only such force to effect an arrest as is ?objectively reasonable' under the circumstances." (Emphasis added; Id., at p. 1198.)

Yeah, Blucher in no way addressed my inquiry as to the actual circumstances surrounding the use of pepper spray. If in fact the protesters were told to disperse (repeatedly) and in fact refused then I don't see that there were many options available. I just wanted to know if they were told to leave and if they were warned several times. I also would like to know what he should have done from those who think what he did was awful.

My question is to those who think this was essessive force is this. If YOU were the cop, YOU tell them to disperse, they won't, and you were ordered to get them out, how would YOU do it?
( and we already know you would not use pepper spray)

That, I think is a very reasonable question along with asking WHO decides what is excessive. Of course we know that there is former law enforcement here so their perspective is predetermined.

Like the cat getting it while at the piano. My cat is an arsehole at times. Like the late Bob Ross getting it while painting a "Happy" little tree. But, the Kent State, Ohio pic reminds me of how silly some of us are to get get our panties bunched up over a little or alot of pepper spray. A .30 caliber bullet, somewhere in your arse, is a little more harder to recover from and death is kind of permanent.
