Prather requests recount, explores legal action

Jude Prather's campaign initiated recount procedures today and said legal action is under consideration. Betsy Robertson, who also lost Tuesday, said she is "at peace."

Is Prather requesting a recount under Title 13, Election Code, or is he contesting the results of the election under Title 14, Election Code?

A recount is only a retabulation of the votes actually cast, which with electronic voting shouldn't change. If they want to try and prove that persons were illegally denied their right to vote and that changed the outcome of the election they need to challenge the election under Title 14 in district court.

At this point we are requesting a recount under Title 13. We do not expect the vote total to change because, as you pointed out, it's almost entirely electronic. But it's a procedural step to proceed to Title 14, if Jude chooses to go that route. By the way, the recount cost us $770 which I think is a good investment in making sure every vote counts.

That's right, been a while since I did any work in that part of the Election Code.
